EUIPO: Decision of the Executive Director: extension of time limits COVID-19
On 11 March 2020, the Director-General of the World Health Organization announced that the outbreak of coronavirus disease (COVID-19) can be characterised as a pandemic. The outbreak has significantly affected worldwide communications, and constitutes an exceptional occurrence, which has disrupted proper communication between parties worldwide and the Office. As a result, the Executive Director of the EUIPO has today (16 March) signed a decision extending all time limits expiring between 9 March 2020 and 30 April 2020, that affect all parties before the Office, to 1 May 2020. In practice, this means that time limits are extended until Monday 4 May, given that Friday 1 May is a public holiday.

As a state in which the European Patent Office is located the Federal Republic of Germany, like many other Contracting States, is experiencing restrictions on the movement and circulation of persons as well as on certain services, exchanges and public life in general, which can be qualified as a general dislocation within the meaning of Rule134(2) EPC. Periods expiring on or after the date of the publication of this notice(15 March 2020) are thus extended for all parties and their representatives to 17 April 2020. In accordance with Article 150(2) EPC this applies also for international applications under the PCT. The above period may be further extended by the publication of another Notice in case the dislocation extends beyond the aforementioned date.
Not all deadlines are subject to be expended, for example the deadline for filing a divisional application.

On account of the unforeseen disruption caused by the COVID-19 outbreak, and being satisfied that it is in the public interest to do so, the Commissioner of Patents, under subsection 78(2) of the Patent Act, the Registrar of Trademarks under subsection 66(2) of the Trademarks Act, and the Minister under subsection 21(2) of the Industrial Design Act have designated for the purposes of subsection 78(1) of the Patent Act, subsection 66(1) of the Trademarks Act, and subsection 21(1) of the Industrial Design Act all days in the period of time beginning on March 16, 2020 and ending on March 31, 2020.

The result of designating these days is that if a time period fixed under the Patent Act, Trademarks Act and Industrial Design Act in respect of any business before the Canadian Intellectual Property Office for doing anything ends on any of these designated days, that time period is extended to the next day that is not either a designated day or a day that has been prescribed under section 5 of the Patent Rules, section 15 of the Trademarks Regulations and section 36 of the Industrial Design Regulations. It should be noted that if the circumstances that led to the designation of these days continues, the Commissioner, Registrar and Minister may decide to extend the period of time for which days are designated.

The Trade Marks Registry: In view of the advisory issued by the Indian Ministry of Health and Family Welfare and concerns raised by stakeholders, all hearings relating to trademark matters scheduled between MARCH 17, 2020 and APRIL 15, 2020 have been adjourned and will be rescheduled in due course of time. At the moment, the hearing schedule post APRIL 15, 2020 remains unaffected.

The Copyright Office: All hearings relating to copyright matters scheduled between MARCH 17, 2020 and MARCH 31, 2020 have been adjourned and will be rescheduled in due course of time.

The IPAB: The Intellectual Property Appellate Board (IPAB) has also issued notifications which convey that matters which were earlier due to be heard MARCH 16 on wards were being rescheduled to a series of dates beginning APRIL 1, 2020. However, filing of fresh appeals, cancellation proceedings and other miscellaneous pleadings in ongoing matters is being done before the Registry of the IPAB in a routine manner. The deadlines for filing appeals, counter statements etc. also continue to remain valid and are not being extended suo moto.
